1. Introduction and scope

Mediafin NV with registered office at Avenue du Port 86C box 309, 1000 Brussels, company number 0404.800.301 (hereinafter “Mediafin“, “we“, “us” or “our”), acts as a controller of personal data in the context of its advertising management (hereinafter “Trustmedia“) and in particular during the provision of certain B2B services as described below.

Explanation of the scope of application – This Mediafin Trustmedia Privacy Statement (hereinafter referred to as the “Privacy Statement”) applies specifically when Trustmedia manages, operates and markets advertising space in newspapers, magazines, websites, (mobile) applications, events, mailings, products and services offered by Mediafin (hereinafter referred to as “Services“). “), or by a third party for whom Trustmedia acts as an external manager, and when these Services are offered to professional/B2B customers (hereinafter referred to as “you” or “your“).

Since Mediafin also acts as a controller in connection with the provision of services to end users/readers of its services, we also refer to Mediafin’s privacy statement for “De Tijd | L’Echo” for more exhaustiveness.

2. Applicable Privacy Law

Mediafin undertakes to process and protect your personal data in accordance with the applicable legislation on the protection of personal data, in particular Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 EC (“GDPR ) as well as national or international laws or regulations that introduce or supplement the General Data Protection Regulation and any other applicable data protection legislation (hereinafter “applicable privacy legislation “).

For the purposes of this Statement, terms such as “personal data”, “controller”, “processing”, “data subject” have the meanings given to them in the applicable privacy legislation.

If the processing or disclosure of personal data as described above is a legal or contractual obligation or a condition necessary for the performance of an agreement, refusal to disclose the personal data may prevent us from entering into such a contract with you and/or providing the service.

Processing of personal data through cookies


Mediafin may also collect and process personal data by using cookies on the Trustmedia website. We process the personal data collected under “strictly necessary cookies” on the basis of our legitimate interest. In other cases (i.e. “non-strictly necessary cookies”), we ask for your consent before placing these cookies and processing your personal data in this context. 5. With who do we share your personal data?

Personal data is processed by Mediafin via Trustmedia and may be shared with:

  • Entities within Mediafin: We may share your personal data with other entities within Mediafin.
  • Suppliers: Personal data may be transferred to other companies, intermediaries, or service providers (“Suppliers”) to perform certain services on our behalf. For example, Mediafin uses subcontractors to provide marketing, communication, infrastructure, and IT services, to process the results of market research. By default, we only let our processors process your personal data to the extent necessary for the provision of their services.
  • Business Transfers: We reserve the right to transfer data, including personal data, in connection with any restructuring, merger, sale, or other transfer of corporate assets, provided that the receiving party agrees to process your personal data in accordance with this Privacy Statement.
  • Authorities: We may also share or transfer personal information, including the content of your communication:
    • To comply with the law or to respond to legal process or requests, including law enforcement and government agencies;
    • To detect, prevent, or otherwise address fraud and technical security vulnerabilities; or
    • To protect and safeguard Mediafin’s rights, including the application of our terms of use.
  • In addition, Mediafin will not pass on your data to other third parties without your prior consent, unless Mediafin is obliged to do so on a legal basis or on the basis of a court decision or if this is justified within the framework of its legitimate interests.

6. How are your personal data secured?

We are committed to protecting the security of your data. We use a variety of security technologies and procedures to appropriately protect your information from unauthorized access, use, or disclosure. For example, we store personal data on computer systems that are restricted in secure buildings.

7.How long do we keep your personal data?

Mediafin does not store personal data for longer than is necessary, depending on the purposes for which it is collected (see section 4 above). In some cases, however, Mediafin is legally obliged to keep your personal data for longer or the retention period is in the context of Mediafin’s legitimate interests.

After the retention period has expired, Mediafin deletes or anonymises the personal data. If deletion or anonymisation is not possible, Mediafin will separate the personal data from further processing until deletion or anonymisation is possible.

8. What are your rights?

Where applicable and in accordance with the applicable privacy law, you have the following rights with regard to the processing of your personal data by Mediafin via Trustmedia:

• Right of access to your data:
You have the right to receive information about whether or not personal data concerning you is being processed and, if so, to access and obtain a copy of it.
• Right to rectify your data:
You have the right to have incomplete, incorrect or outdated personal data deleted or rectified.
• Right to erasure of your data:
In certain cases, you have the right to obtain the erasure of personal data concerning you. For example, when the use of your personal data is based on consent and you have withdrawn your consent, when such personal data must be erased due to a legal obligation or when the personal data has been processed incorrectly.
• Right to restrict the processing of your data:
In certain cases, you have the right to restrict the processing of personal data concerning you. This may be, for example, if you believe that the personal data is not correct during the period when we need to verify the accuracy of the personal data or if the processing is unlawful, but you do not want the personal data to be erased.
• Right to object to the processing of your data:
You have the right to object to the processing of your personal data in certain cases, for example where the processing is based on our legitimate interest.
• Right to data portability:
You have the right, in certain cases, to obtain the personal data concerning you, which you have provided to Mediafin yourself, in a structured, common, and machine-readable form, and to transfer it to another controller.
• Right to withdraw consent at any time:
As far as the processing is based on consent, you have the right to withdraw your consent at any time. Withdrawing your consent does not affect the lawfulness of any processing we have conducted prior to the withdrawal or any processing of your personal data that is conducted on legal bases other than your consent.
• Right to object to the processing of your data for direct marketing purposes:
You can exercise this right by clicking on the “unsubscribe” link in the marketing emails we send you. Please contact us at privacy@mediafin.be. to unsubscribe from other forms of marketing.
• Right to lodge a complaint with the Data Protection Authority:
If you have a complaint or are concerned about how we process your personal data, we will endeavour to resolve these issues. If you believe that we have not adequately addressed your complaint or concern, you have the right to complain to a supervisory authority about our collection and use of your personal data. Mediafin reserves the right to change this privacy statement at any time. We will notify you of such changes, considering their significance and our legal obligations in this regard. In any case, we recommend that you regularly review this privacy statement, so that you are aware of any changes and are always aware of how your personal data may be used.

11. Applicable law territorial jurisdiction  

Belgian law applies to this Privacy Policy. Disputes regarding this privacy statement fall under the exclusive competence of the Dutch-speaking courts and tribunals in Brussels.

Identity of controller

Mediafin NV, with its registered office at Havenlaan 86C box 309, 1000 Brussels, company number 0404.800.301 (hereinafter “Mediafin”, “we” or “us”), acts as the data controller for the processing of your personal data in the context of its advertising sales house activities (hereinafter “Trustmedia”) and, in particular, in the provision of certain B2B Services as described below.

This general privacy statement for events (hereinafter the “Privacy Statement”) contains essential information on how Mediafin, as data controller, collects and processes your personal data, including for which purposes, for how long, and what your rights as a data subject are when you register for and participate in an event organised by Mediafin. This Privacy Statement supplements Mediafin’s general privacy statement, which is available here.

This Privacy Statement applies to events organised by Trustmedia, including, but not limited to, Power of ESG, Future of Europe Private Drink, and B2B Marketing Conference.

The above list of events is not exhaustive. If new events are organised by Mediafin in the future, this Privacy Statement will also apply to them. Where there are substantial differences in the processing of your personal data in the context of such events compared to this Privacy Statement, we will draft a separate privacy statement specifically applicable to the relevant future event and inform you accordingly.

Applicable legislation

Mediafin undertakes to process and protect your personal data in accordance with applicable personal data protection legislation, in particular Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 EC (“AVG”) as well as national or international laws or regulations introducing or complementing the General Data Protection Regulation and any applicable data protection legislation. With whom will your data be shared?

We guarantee that your data will only be shared within Mediafin to enable the organisation of events. Only when there is a co-organiser of the specific event, your personal data will also be shared with them.

When you give your consent to receive communications from our partners, your personal data will of course also be shared with them so that they can contact you. We ensure to always sign an agreement with this party that includes safeguards for the correct and secure processing of your personal data in accordance with applicable legislation, such as the GDPR.

At some of our events, break-out sessions and workshops are organised by our partners. If you participate in break-out session, your personal data will be shared with them. We also enter into GDPR agreements with them to ensure that your personal data is processed correctly and securely.

If your data is transferred outside the European Economic Area to a third country that does not benefit from an adequacy decision by the European Commission, we guarantee that we will implement appropriate safeguards to secure this international transfer, such as entering into Standard Contractual Clauses with the contracting party in the third country in question.

How long will your data be kept?

Mediafin retains your personal data for no longer than is strictly necessary for the fulfilment of the purposes for which we collected the data, e.g. for the performance of a contract or to comply with a legal obligation. Retention periods differ with regard to the type of processing activity and the purpose for which the personal data was collected.

For example, personal data may be kept longer if there is a legal or regulatory reason to do so, or shorter if the data subject objects to the processing of his/her personal data and if there is no longer a legitimate reason for us to keep it.

We guarantee that we will provide only limited access to archived data and that we will delete or anonymise your personal data once the retention period has expired.

Your rights

In accordance with the GDPR, you have the following rights:

If handling your request requires unreasonable measures (e.g. it is technically or organisationally virtually impossible or extremely costly), Mediafin may charge you a reasonable fee in light of the administrative costs involved in handling the request. We may also refuse to process requests that are excessive, in particular due to their repetitive nature. You may exercise these rights by sending an email to our Data Protection Officer (“DPO”) at the following email address privacy@mediafin.be. We will handle your request in accordance with applicable privacy laws.

Security

Mediafin has implemented technical and organisational security measures to prevent the destruction, loss, falsification, alteration, unauthorised access or disclosure of your personal data to third parties and any other unauthorised processing of such data. We have made every effort to ensure the confidentiality, integrity and availability of the information systems and services in which personal data are processed. All our employees and third parties engaged by us are obliged to respect the privacy and security of your data
